Auto Claims Tips
If you are in an auto accident, there are four things to remember to do. Stop your car, see if anyone is hurt, assess the damage and then get as much information as possible about the accident.
At the scene of an accident it is recommended that you:
- Find out if anyone is injured; Call 911 let them know how many people were hurt and the extent of their injuries
- Protect the accident scene; Take reasonable steps to protect your car from further damage by setting up flares, getting the car off the road and calling a tow truck if necessary
- Collect as much information as possible; On a pad of paper take notes, keep a disposable camera in your car, or use your cell phone to take pictures of any damage done to the vehicles
- Make sure you get the following information:
Names, addresses and phone numbers of all drivers and passengers involved in the accident, license plate numbers, make and model of each car, driver's license numbers and insurance information
Names, addresses and phone numbers of any witnesses
Names, badge numbers and contact information of police, highway patrol or other emergency personnel at the scene. Remember to ask where you can obtain a copy of the Police Report;
you will need it when filing a claim
Make note of the date, time, location and other relevant information such as driving conditions
To file an auto insurance claim, it is suggested you:
- Get in touch with your insurance agent as soon as possible, regardless of who is at fault.
- Find out what forms or documents you will need to support your claim. Insurance sometimes requires a "proof of claim" form, and a police report if there is one.
- Get the names and phone numbers of everyone you speak with throughout the insurance claims process and keep copies of any bills or documents you supply to your insurer.
- Ask your agent or company representative the following questions:
Does my policy contain a time limit for filing claims and submitting bills?
Is there a time limit for resolving claims disputes?
If I need to submit additional information, what is the cutoff point?
Do I need to get repair estimates for the damages to my car?
Will my policy pay for a rental car while my car is being repaired?
Texas has laws governing the claims process and you have rights and obligations under those laws. Be sure and review this with your agent.

Homeowners Claims Tips
Standard homeowners property insurance policies will pay for a covered loss. Read and understand your policy before filing a claim. Call you insurance agent to review this process.
Did you know standard homeowners insurance policies also include coverage for additional living expenses? This pays the additional costs of temporarily living away from your home if it is uninhabitable due to an insured loss.
In the event of a covered loss it is suggested you:
- Report any burglary or theft to the police and get a copy of the police report, as well as the officer's name and contact information.
- Notify your insurance agent, find out if you're covered for the loss, ask questions to make sure you understand the claims process, be prepared to give your agent or insurance company a description of the covered loss, once the loss is recorded a qualified adjuster will contact you quickly to inspect the loss.
- If you have to evacuate, make sure to give your agent a telephone number where you can be reached.
- In the event of loss document your loss; prepare a detailed inventory of all damaged, stolen, lost or destroyed personal property, make your list as complete as possible, include: description of items, dates of purchase or approximate age, cost at time of purchase and estimated replacement cost, provide canceled checks, invoices, receipts or other papers that will prove value to the adjuster.
- If able to access your property, make temporary repairs to prevent further destruction, save receipts for supplies and materials, insurance companies reimburse you for reasonable expenses in making temporary repairs.
- Secure a detailed estimate for permanent repairs to your home from a reliable contractor and give it to the adjuster, the estimate should contain the proposed repairs, repair costs and replacement prices.
- If you have to find other accommodations while your home is being rebuilt save the receipts.
- Fill out all claim forms correctly and promptly, insurance companies place time limits on filing claims.
- Keep good records, make copies of claim forms and receipts, get the name and phone number of insurance company personnel and anyone else you may have dealt with regarding your loss.
- Those with flood insurance through the National Flood Insurance Program (NFIP) should contact the insurance agent or company representative who sold that policy in order to file a claim.
In case of catastrophe serious claims will be given priority. So be patient under those circumstances if your loss is manageable until help can arrive.

Business Claims Tips
Whether your business claim involves property, liability, workers compensation, auto or some other type of insurance coverage, your policy describes your obligations in the event that you have a claim. Read and review your policy before filing a claim. Call your insurance agent to review this process.
- Property Claims; your policy describes all your obligations in the event of a property claim. Among other things, the Business Owners Policy (BOP) obligates you to:
Contact your agent and insurance company right away
Report any violation of the law to the police immediately
Take steps to protect your property from further damage by making temporary repairs; if immediate repairs to equipment are necessary, save the damaged parts in case the claims adjuster is interested in examining them
Resume all or part of your operations as quickly as possible
- Business Income Claims; if your policy provides business income coverage, you will need business records, such as those listed below, to establish the amount of your insurance benefits; they include:
Historical sales records
Income and expense information shown in recent profit and loss statements or income tax forms
A record of extra expenses incurred to resume business operations after a covered loss; expenses could include temporary rental space, temporary equipment rental or moving expenses
Receipts/records for damaged inventory
Other business records that may support projected business profits, had a loss not occurred
- If You Have a Liability Claim; if threatened with a lawsuit, contact your insurer about the possibility of a liability claim; however, events could result in a liability claim but may not: an example is when a third party suffers a fall on your premises, at the time you do not know whether the person will sue.
This is the type of “occurrence” that could lead to a lawsuit and that a BOP requires you to report. Provide specifics of the event and contact information for any witnesses. The BOP also requires that you should not incur any expenses, other than for first aid, for anyone who claims to have been injured.
If there is a lawsuit, you must notify the insurer immediately and cooperate in the investigation and defense of the case.
- If You Have a Workers Compensation Claim; contact your insurer quickly if an employee has a work-related injury; immediate action in providing an assessment of the accident and medical care can often help accelerate the employee’s recovery, rehabilitation and return to work, you are obligated to cooperate in the insurer’s investigation of the claim, providing records and any other information requested.
- If You Have an Auto Claim; employees who drive vehicles on business, whether their own or the company’s, should be instructed on how to respond in the event of an accident.
After an accident, call 911 and have the police dispatched so that they can make an accident report. Obtain names and contact information for any witnesses. Notify your insurance agent quickly of the accident and cooperate in the insurer’s investigation.
Texas has laws governing the claims process and you have rights and obligations under those laws. Be sure and review this with your agent.
